Based on the regulations regarding land acquisition, in the case of certain land parcels affected by land acquisition, there is residual land which can no longer be used according to its designation and use, the entitled party can request full compensation for the land. In land acquisition for the construction of the Jakarta-Bandung Fast Train (KCJB) in Bandung Regency, there are obstacles in resolving compensation for the residual land. Therefore this research was carried out. This research also provides an overview of the problems in providing compensation for residual land in land acquisition for the construction of KCJB in Bandung Regency and its solutions.
The research method used in this research is a qualitative descriptive approach with a case study method. In this study, the selected cases were related to the problems and the settlement of the implementation of compensation for the residual land in land acquisition for the KCJB development. The selected location is represented by 6 (six) villages in Bandung Regency which have residual land problems.
The existing regulations have not detailed the criteria for the residual land which can be compensated or not, while the problems encountered by the executing committee for land acquisition in the field regarding the residual land are quite diverse. In implementing compensation for the remaining land, the land acquisition committee divides it into two categories based on land area, for areas less than 100 m2 and more than 100 m2.
From the results of the research it was found that, not all residual land parcels could be compensated due to budget constraints. 65 plots of residual land have been compensated, while other land parcels have been given other solutions. Therefore, it is necessary to improve the regulations regarding the residual land, and the budgeting for the payment of compensation for the residual land at the planning stage of land acquisition..
