The President emphasized the obligation of land registration to the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) through Presidential Instruction Number 2 of 2018 concerning Acceleration of Complete Systematic Land Registration (PTSL) throughout the Republic of Indonesia. The fact is that the PTSL Policy has encountered obstacles since the policy to stop issuing new license through Presidential Instruction Number 5 of 2019 concerning Cessation of Issuing New License and Improving Governance of Primary Natural Forests and Peatlands. As a follow-up to Presidential Instruction Number 5 of 2019, the Ministry of ATR/BPN through the Secretary General of the Ministry of ATR/BPN issued a letter instructing Land Offices throughout Indonesia to publish certificate publications including PTSL if they are in the location of the issuance cessation of new licenses according to the Cessation of New License Issuance Indicative Map (PIPPIB) issued by the Ministry of Environment and Forestry (KLHK). This has resulted in disharmony or policy inconsistency.
The purpose of this study was to determine the synchronization of spatial planning policies between the PIPPIB and the Riau Province Regional Spatial Plan (RTRW), then the impact of the policy to stop the issuing of new license on the implementation of PTSL at the Land Office of Indragiri Hilir Regency, so that it can provide policy recommendations. This study used a qualitative descriptive method with a normative and spatial juridical approach.
The results of spatial analysis, synchronization can be implemented from the area and position of the location that regulates it. The peatland area of PIPPIB 2019 is not match with the peatland area in the Riau Province RTRW. Likewise, the position of peatland and primary natural forest is not yet in match with the position of peatland and forest areas in the RTRW of Riau Province. The results of the comparative analysis show that the policy to stop the issuance of new licenses resulted in the cessation of issuance of land certificates from the implementation of PTSL. This impact was caused by the inaccurate meaning of license and land rights. The policy recommendation is synchronization between the policy to stop the issuance of new licenses against the spatial planning policy and the PTSL policy, namely by means of; (a) to issue a spatial planning policy so that PIPPIB considers the RTRW; (b) there is a need for a policy to restore the concept of land rights that have a higher position than license; (c) it is expected to revoke the letter from the Secretary General of the Ministry of ATR / BPN; (d) to issue a PTSL policy on land parcels located in the location of new license cessation by issuing land title certificates accordingly. If the final result is the certificate can be issued, the Land Office can report it to the Ministry of Environment and Forestry (e) good coordination by policy makers so that commitment in implementing mutually agreed policies can be achieved
