Control over land assets of PT. Kereta Api Indonesia (Persero) is based on grondkaart. Grondkaart's position as a product in the past is still interpreted when it is reviewed its application in the present. In Semarang City, the overlap between community property rights and land assets of PT. KAI (Persero) which is based on grondkaart with a decision in the form of cancellation of 56 (fifty six) HM certificates.
The research objective was to determine the position and legal consequences of grondkaart. The method used in this juridical normative research examines several statutory regulations and studies court decisions and empirical juridical with the results of interviews. The results showed that the original grondkaart could never be shown by PT. KAI and is always used as supporting evidence in court.
The conclusions of this study: 1). grondkaart in the AW era 1870 as evidence of ownership while the LoGA era was the basis for land tenure rights. 2). The legal consequence of grondkaart is as a basis for physical possession rights as a condition for the issuance of a certificate while in court freekaart is one of the means of written evidence (Article 1866 of the Civil Code).
