In 1988, PT. BMS acquired Cultivation Rights Title (CRT) as wide as 6.925 acres in Kabupaten Rejang Lebong. The land acquisition process after CRT has been given through land relinquishment, however PT. BMS only able to relinquish people?s land as wide as 2.046 acres, so that it caused the right uncertainty upon people?s land. The condition later on was causing land ownership and authorizing overlapping of PT. BMS CRT that ended by the right reclaiming and cancelling upon the land. This research that used legal research method which has analytic descriptive characteristic by using normative judicial and emphirical judicial method was aimed to explain factors why people was performing the cultivating upon state land of former PT. BMS CRT, mechanism and obstacle on the right strenghtening upon the land for cultivator farmers by using interview, observation and literature study technique and later on the obtained information was analyzed in qualitative manner.
This research was successed in finding some important matters, that legal affirming toward PT. BMS CRT object as wide as 6.925 acres as state land has made Letter of Decision of PT. BMS CRT became legal defect. After acquiring CRT, PT. BMS was simply able to relinquish the land as wide as 2.046 acres so that the unrelinquish part permanently being cultivated by by people as the owner. Moreover, PT. BMS was also less optimal in using its land to plant cacao that ended by right cancellation. The Land Agency Office of Kabupaten Rejang Lebong has attempted to give right strengthening for the cultivator farmers through land redistribution, however it has obstacles.
According to the study result and field findings, the writer concluded that it was necessary to present the right strenghtening for cultivator farmers considering from the consequences of the right cancellation was simply delete the right upon the land but not the right of possession. The people has the possession right upon the land of CRT area that never been relinquished. This was also to avoid conflict as the consequences of the right uncertainty upon the land for the cultivator farmers.
This research result was suggested some alternatives for the right strengthening policies upon the land for cultivator farmers, such as land redistribution, letter of cultivating approval, and plasma core plantation. The most possible of policy performing by Land Agency Office of Kabupaten Rejang Lebong upon people?s land that never been relinquished was by giving direct ownership right. Meanwhile, for the land as wide as 2.046 acres was able to perform through land redistribution mechanism.
