The purpose of this research was to determine why people are still buying and selling of land without land title made by Land Deed Official. It is important to know because the people in the District Tlogomulyo, Temanggung regency, still buying and selling land without land title made by Land Deed Official. Administratively, based on Government Regulation No. 24 Year 1997 on Land Registration, initial registration those comes from land transactions must be registered under the letter made by Land Deed
Official.
This research uses normative research and empirical juridical methods. Type of research being used was statute approach and analytical approach. In the analysis process, it was used a primary and secondary data, thus it can be taken a prescriptive conclusion by using inductive logic.
The results of this research showed that: first, the community in Tlogomulyo District still buying and selling of land without land tittle deed due to several reasons, namely: efforts for cost reduction of land tittle, the process of the making of a purchase agreement of land more easily and quickly, land buyers still feel safe even without land title deed, and lack of public knowledge about role of Land Deed Official in initial registration. Second, formally, land transactions without the letter made by Land Deed Official have no legal certainty because it does not have strong evidence, but the fact, this situation still recognized and carried out by people in Temanggung and still get recognition from the court there. Third, Initial Registration in Temanggung District Land Office which Obtained from the shift of buying and selling land required to use letter made by Land Deed Official. It is based on Government Regulation No.24 of 1997 on Land Registration, junto PMNA / KBPN 3 of 1997 and the letter of the Director General of Taxation on March 27, 1993 Date with No. SE-15 / PJ.6 / 1993.
