many years ago. This land dispute is a dispute in claiming land occupation between the heir of XaveriusDotulong, Lembeh Island inhabitant and government in this term is North Sulawesi Province Government Bitung City Government, National Land Agency Regional Office of North Sulawesi Province and Bitung City Land Office. The objectives of this research were to discover the history of land occupation in Lember island of each disputants so with the history of the land occupation can be discovered the root of the issue and to discover efforts can be applied in solving land dispute in Lembeh Island and it was expected through
these efforts the land dispute can be resolved peacefully.
Research method used was normative empirical legal research with qualitative analysis. Empirical legal research was to discover the history of land occupation from each disputant and its settlement efforts whereas normative legal research was used in performing problem analysis. There were two types of data used here namely primary data and secondary data in which secondary data was divided into three namely primary legal material, secondary legal material and tertiary legal material. This research was held in Lembeh Island, Bitung City, Province of North Sulawesi.
Research result was the determination of Lembeh Island as a land directly occupied by Government based on Decree of Minister of Home Affairs Number. 170/DJA/1984 has referred to an applicable regulation. Regarding occupation evidence submitted by the heir of XaveriusDotulong, then the researcher�s legal analysis on Lembeh Island Land can be categorized as private land, maximum
overload, absentee and eigendom land that were not converted to specified time. Based on above analysis, then it was natural if the government made the Lembeh Island as wide as 2.740 ha as redistribution object in context of landreform, because the above has met land criteria that will be distributed in context of land reform based on provision of Article 1 PP 224/1961.The effort to settle land dispute in Lembeh Island can be taken by deliberation amicably or mediation by presenting all disputants without any partisanship. The decision making from the deliberation result can also be supported by reality existing in field based on
inventory activity result by considering aspiration from disputants.
This research can provide contribution for Ministry of Agrarian and Spatial/National Land Agency in solving land dispute in Lembeh Island. This research result can also be made as benchmark for policy making by government that can be seen from history of the land occupation by each party and alternative settlement of land dispute in Lembeh Island.
