The change of Right to Cultivate (HGB) into Right to Ownership for residential house has been carried out by all Land Offices throughout Indonesia. Latest legal basis as reference in its implementation are KMNA/Ka. BPN Number 6 Year 1998. However in its implementation the Land Office of Kudus District does not fully the same with KMNA/Ka. BPN Number 6 Year 1998. This
research was performed to describe the implementation of the change of HGB into Right to Ownership for residential houses at Land Office of Kudus District, to describe the conformity of implementation of the change of HGB into Right to
Ownership for residential house against KMNA/ Ka.BPN Number 6 Year 1998, as well as to learn the problematic of implementation of HGB change into right to ownership for residential houses.
This research used juridical normative and juridical empiric legal research method with statute approach and analysis. Juridical normative was used to study problematic of related law and legislation and juridical empiric used to study
implementation in field. Method in collecting material was by using documentary study and interviews. In the drawing of conclusion researcher was using inductive method.
Based on research result indicated that the implementation of the change of HGB into Right to Ownership for residential houses has not fully in accordance to KMNA/Ka. BPN Number 6 Year 1998. This discrepancies comprised legal basis used, additional requirement in form of Sell and Puchase Deed, implementation of field inspection that was not in accordance to AAUPB, and at the HGB that has ended its period was processed through Land Rights. Encounter problematics were application of right transfer which did not have any permanent buildings was still found, there was a dissenting opinion during the implementation of the
change of HGB into Right to Ownership regarding field review and HGB that ended its period, as well as lack of community�s confidence to obtain land certificate independently. In order to create a good government that has a product with legal certainty
it is expected that the Land Office of Kudus District carries out the change process in accordance with KMNA/Ka. BPN Number 6 Year 1998, does not put additional requirements in form of AJB to community, could provide socialization/consultation regarding the easiness of the process to get Right to Ownership for residential houses.
