Land dispute is a quite complicated and sensitive issue, since it related with many life aspects either socially, economically, politically, psychologically, thus in its settlement the land dispute does not merely pay attention on juridical
aspect but also must be noticing on other life aspects in order the settlement of those issues do not develop into restlessness which may disrupt community�s stability. At present the dispute settlement through legal action does not always
settle the problems, hence mediation is taken as alternative for the issues settlement. Generally mediation is conducted before trial or during trial before inkracht van gewijsde ruling is issued, however in Kediri City, Province of East
Java the land dispute settlement in Civil Suit Number 24/Pdt.G/2008/PN.Kdr was taken through mediation after the execution. Following up this mediation result, Land Office of Kediri City had ignored the Court Ruling by not performing
certificate cancellation which declared it did not have any legal force. The aim of this research is to discover the Land Office�s ground in not performing certificate cancellation in order to implement Court Ruling, to learn the power of deed of peace after execution compared to Court Ruling that has a permanent legal force; as well as to learn implication of mediation result after execution to the parties.
This research used empirical legal method with statute approach and analytical approach. Result of this research indicates that: First, the Land Office of Kediri City ground for not performing certificate cancellation in order to carry out Court
Ruling was due to the existence of peace among the disputed parties. Second, the deed of peace did not have executorial power as put forth on Court Ruling that has been inkracht, unless if the Deed of Peace was strengthened with the Peace Ruling. Third, implication to the parties with the existence of mediation result after execution was it had not provide any legal certainty, but the benefit was the mediation result provided many benefits for the parties.
