Land Registration is held by Government in order to ensure legal certainty of a land right. The final stages in land registration activity is granting of strong evidence namely certificate. Certificate is strong evidence and not absolute evidence, hence it can be sued in Court. As occurred in Supreme Court Ruling Number 629K/Pdt/2004, which one of rulings stated that Land Certificate Number 1044, 1045, 1047 and 1048 in Kemudo Village was stated as do not have any legal force (cancelled). This essay�s objectives were to discover the cause of cancellation based on Supreme Court Ruling Number 629K/Pdt/2004 and the follow up conducted by Klaten District Land Office on the cancellation of the court ruling which already had a permanent legal force.
Type of this research was juridical normative and juridical empirical research, with statute and study case approach. Juridical normative is used to study cases on related statute regulation and juridical empirical was used to study its implementation in field. Method of material collection was by using documentary and interview study. Documentary study was used to collect legal material both primary and secondary legal materials, interview was used to collect non legal material to clarify the legal materials. Legal material and non legal materials were then processed and analyzed by using descriptive analytical technic.
Based on research and analysis result can be concluded that: First, the cause of cancellation on land right based on Supreme Court Ruling Number 629K/Pdt/2004 was due to lawsuit from the heirs to obtain their inheritance rights since the certificate of inheritance (containing division of inheritance) that has been made was legally flawed. Second, follow up performed by Klaten District Land Office to Supreme Court Ruling Number 629K/Pdt/2004 was by recommending the issuance of Land Right Cancellation Decree to Head of Regional Office of Central Java Province. Land Office, has not cancel the old certificates and issue a new certificate due to the absence of application from the concerned.
