Article 29 paragraph (1) Government Regulation Number 24 Year 1997 regarding Land Registration state that every bookkeeping in land registration book should contain juridical and physical data based on facts in field. Majority of recording activity on transfer of matrimonial property right at Pangkalpinang City Land Office is recorded on behalf of one of their name. Therefore this is not in accordance to content of Article 29 paragraph (1) and likely can generate problematic in future days. This essay was aimed to learn the implementation of recording of matrimonial property right transfer and issues that could be emerged as effect of the implementation of recording of matrimonial property right transfer at Pangkalpinang City Land Office. This research type was juridical normative and juridical empirical research, with statute and analytical approach. Juridical normative was used to study problematic of related law and regulation and juridical empirical was used to study the implementation in field. Material data collection method was by using documentary and interview study. Documentary study was used to collect legal materials both primary and secondary legal material, interview was used to collect non legal material to clarify the legal material. Legal and non legal materials was then processed and analyzed by using prescription technique. From the analysis result was derived that majority of recording of transfer of matrimonial property right was recorded on behalf of one of the name. Problematic that might be occurred were including inconvenience of husband and wife that was not listed in land registration book including unilateral transfer, mortgaging certificate in private and falsification of information. The land deed registrars (PPAT) was having difficulty in determining type of property if it was not completed with other requirements such as ID, Family Registration Card and Land Registration Book, Land Office considered an absolute truth and Sell and Purchase Deed that was made by the Notary PPAT. Philosophically, community that listed was considered as the owner with full authority over the land. The form of agreement of matrimonial property recording on the certificate was influenced by religion, economic, social and justice factors. Solution of matrimonial property recording in comparison of Sell and Purchase Deed and Land Registration Book is recorded on behalf of both names.
