National Land Law System is one law system exist in Indonesia that acknowledge religion element as one of its development structure. Article 6 UUPA stating that land has a social function, which means that if a plot of land is required for development of public interest then the government has authorization to takeover the land based on applicable law and regulation or termed as land procurement for public interest. Islamic law also regulates private ownership over a land. The use of land right according to Islamic Law is based on principles applied in Islamic Law.
The objectives of this research were to discover the principle of land procurement for public interest, public interest concept, and mechanism of land waiver for public interest according to Islamic Law and National Land Law.
Type of research conducted was normative legal research or library research. Based on its objectives� perspective, type of normative or library legal research one of them was legal comparison research. Legal comparison method was applied by using legal system elements as starting point of comparison comprises three main elements namely legal structure, legal substance, and legal culture. Comparison can be conducted to each element or by cumulative to all of them. At this research things that were
compared were legal substance element in form of rule and legal principles
between Islamic Law and National Land Law.
Result of this research expressly and implicitly contained equality of land procurement principle for public interest between Islamic Law and National Land Law. In addition there were also differences of principles but it did not contradictory. There were essential equality of public interest according to Islamic Law and National Land Law, but there were also differences at its category. Either according to Islamic Law or National Land Law they both recognized mechanism of land right waiver forcibly
and voluntarily.
